    A previous study ( Research Relating to State Highway Laws , reported January 1967) afforded us an opportunity to review a vast array of literature and statutory law pertaining to enabling legislation and administrative authority to construct and maintain highways. It was surprising to find that the statutes are void of guidance on certain subjects: there are great bodies of unwritten or non-statutory laws which are referred to as common law and civil law , which are deeply rooted in the past; many are doctrinal or equitable; many are extraordinary and argumentative -- they should not be confused with Civil Procedure. They have been described as the laws of private rights and offer redress of grievances when statutory or constitutional laws are not specific. The right to own and possess land is constitutional; riparian rights attach -- some authorities contend that riparian rights cannot be severed and sold. Formerly, the attitude toward ownership of land was that rights extended from the center of the earth to the sky above and that owners rights were inviolable except through eminent domain and due process . Modern attitudes superimpose a limited-use or public interest condition upon private ownership. Even so, an owner of land may not perpetuate a nuisance or use his land in ways which are injurious or damaging to others. Interestingly enough, a nuisance does not exist until someone is injured by it; priority of occupation does not constitute a prescriptive right. The Department incurs liabilities when private rights are invaded or usurped. In some jurisdicions the state has been held liable in the same manner as a private owner; where sovereign immunity persists, damage to private property may be described as nuisance , trespass , or negligence . Ultimately, such actions are held as a taking of or adverse possession of private property

    Multiple physical and chemical techniques including mass spectroscopy, atomic absorption spectroscopy, gas chromatography, electron microscopy, optical microscopy, electronic spectroscopy for chemical analysis (ESCA), infrared spectroscopy, nuclear magnetic resonance (NMR), X-ray analysis, conductivity, and isotopic labeling were used in investigating the atomic interactions between organic environments and titanium and titanium oxide surfaces. Key anhydrous environments studied included alcohols, which contain hydrogen; carbon tetrachloride, which does not contain hydrogen; and mixtures of alcohols and halocarbons. Effects of dissolved salts in alcohols were also studied. This program emphasized experiments designed to delineate the conditions necessary rather than sufficient for initiation processes and for propagation processes in Ti SCC

    A Study to Validate a Self-Reported Version of the ONS Drug Dependence Questionnaire

    Aim: A prospective study to establish the reliability of a self-completion version of the Office for National Statistics (ONS) questionnaire for assessing drug dependence of substance misuse clients. Method: A total of 47 treatment seeking opioid-dependent clients completed the self-complete version of the ONS questionnaire (ONS-sc) followed by the interviewer-administered ONS questionnaire (ONS-ia) at a single clinic appointment. Scores for four Class A drugs (heroin, methadone, speed and crack/cocaine) from both formats were compared. Results: The observed agreement was 87% or more and Cohen's kappa was 0.7 (p < 0.001) or more for all four Class A drugs. Sensitivity for each Class A drugs was 56% or higher and specificity was 87% or higher. Sensitivity for severe heroin dependency was 98% (CI 89–100%). There was a 100% correlation between the ONS-sc and positive urine analysis for heroin use. However, methadone and crack/cocaine drug use appeared under reported. Conclusion: ONS-sc is a feasible, practical and time-saving alternative to a detailed interview on drug dependence. Further research with a larger sample size and non-opiate-dependent clients are needed, as this could prove a useful tool for monitoring clients in everyday practice, or for survey purposes where interviews are impractical

    Linear modeling of possible mechanisms for parkinson tremor generation

    The power of Parkinson tremor is expressed in terms of possibly changed frequency response functions between relevant variables in the neuromuscular system. The derivation starts out from a linear loopless equivalent model of mechanisms for general tremor generation. Hypothetical changes in this model from the substrate of the disease are indicated, and possible ones are inferred from literature about experiments on patients. The result indicates that in these patients tremor appears to have been generated in loops, which did not include the brain area which in surgery usually is inactivated. For some patients in the literature, these loops could involve muscle length receptors, the static sensitivity of which may have been enlarged by pathological brain activity
